How to Handle Birth Procedures in Azerbaijan

Giving birth abroad involves important legal procedures for both the parents and the newborn. Thanks to the close ties between Turkey and Azerbaijan, official post-birth procedures in Azerbaijan follow specific regulations. Based on the experience of Cosmos Legal Law Office, we outline step by step how birth procedures are carried out in Azerbaijan.

1. Obtaining the Birth Certificate
After the baby is born in Azerbaijan, the first step is to obtain a birth certificate (birth report) from the hospital where the birth occurred. This document officially records the baby’s date and time of birth, parental information, and the place of birth.

2. Registering the Birth with the Civil Registry
Once the birth certificate is obtained, parents must officially register the birth with the Azerbaijan Civil Registry Office (ASAN Service or local ZAGS office). Required documents include:

  • Passports of the mother and father

  • Birth certificate

  • Marriage certificate (if available)

  • Application form

After submission, an official Azerbaijani birth registration certificate is issued for the baby.

3. Citizenship Status
According to Azerbaijani law, citizenship at birth is based on both jus sanguinis (bloodline) and, under certain conditions, jus soli (birthplace).

  • If either parent is an Azerbaijani citizen, the baby automatically acquires Azerbaijani citizenship.

  • If both parents are foreign nationals, the baby retains the parents’ citizenship. In this case, Azerbaijani citizenship is not automatically granted even if the birth occurs in Azerbaijan.

4. Notification to Turkey (For Turkish Citizens)
Turkish citizens must report the birth of their baby in Azerbaijan to Turkey. Required documents include:

This should be submitted to the Turkish Embassy in Baku or the consulate, after which the baby’s information is recorded in Turkey’s civil registry, and a Turkish birth certificate is issued.
